This document serves as the contract between you, the account holder, and Instapay. It outlines the additional terms and conditions for domestic and international fund transfers offered through the Instapay Mobile Application (“Instapay App”). Together with the Cardholder Agreement and Terms of Use for the Instapay Card and App, these terms collectively govern the use of remittance services and are binding on you (referred to as the “Remittance Terms and Conditions”).
By accessing or using the domestic and international fund transfer services, along with any content, features, technologies, or functions provided through the Instapay App (collectively referred to as the “Remittance Services”), you agree to the Remittance Terms and Conditions and our Privacy Policy. If you do not agree to these terms, please refrain from using the Remittance Services.
Additional terms may apply to the Remittance Services for specific events, activities, or promotions organized by Instapay. These supplemental terms will be communicated to you during the relevant period. They will be considered part of the Remittance Terms and Conditions for the Remittance Services and will take precedence over those terms in case of any conflict.
1.1 The agreement is between you (the account holder) and Instapay Technologies Sdn Bhd (Company Registration Number: 1233660-AA), with the principal office at 23A-16, Q Sentral, Jalan Stesen Sentral 2, Kl Sentral, 50470 Kuala Lumpur, Malaysia. Instapay is regulated by Bank Negara Malaysia (BNM) as an e-money issuer and also has a Money Services Business Class B license from BNM.
Along with the definitions already provided in the Cardholder Agreement and/or Terms of Use for the Instapay App (which also apply to these Remittance Terms and Conditions unless specified otherwise), the following definitions apply to the terms used in these Remittance
Terms and Conditions:
“Account” means your Instapay e-wallet account designated, maintained and operated by Instapay in relation to your Instapay e-wallet.
“Applicable Laws” refers to the laws that govern the provision of the Remittance Services. This includes, but is not limited to, the Money Services Business Act 2011 (MSBA), the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001 (AMLATFA),
the Financial Services Act 2013 (FSA), and any other relevant laws that apply to the provision and use of the service in Malaysia, as well as in the jurisdictions where funds are sent, including those of the beneficiaries, if applicable.
“Available Balance” means the actual amount of funds available at any time (subject to the appropriate Emoney purse limit) for usage in your Account.
“Beneficiary(ies)” or “Recipient” means the individual designated by you in a Transaction order as the recipient of the funds to be disbursed upon the completion of the processing of such Transaction.
“E-money” refers to the electronic money linked to your Account, which is a system for issuing electronic money as a designated payment instrument under the Financial Services Act 2013.
“Remittance Terms and Conditions” refers to this agreement along with the terms and conditions included herein.
“Remittance Services” or “Service” denotes the transfer of funds via wire transfer, which encompasses domestic fund transfers within Malaysia or international cross-border transfers from Malaysia to other jurisdictions, provided by Instapay through the Instapay App in accordance with these Remittance Terms and Conditions.
“Sender” means you, being the Account holder who places the order with Instapay via your Account and authorizes the wire transfer from your Account via the Instapay App for the purpose of processing of the Transaction by Instapay; “Transaction” means a wire transfer of funds using the Remittance Services including without limitation the specific instruction or order you have submitted to Instapay to send a remittance of money for the benefit of a Beneficiary through the Remittance Services and the acceptance of such remittance of money by the Beneficiary;
“Transaction Amount” means the amount of funds you wish to transfer to your Beneficiary; and
“Transfer Fee” means the fee charged by Instapay in connection with Instapay’s acceptance and processing of a Transaction order submitted by you in respect of the Remittance Services.
Throughout these Remittance Terms and Conditions, the terms "Instapay", "we", "us", and "our" refer to Instapay Technologies Sdn Bhd and/or any of our subsidiaries and affiliates. The terms “you” and “your” refers to you as a user of the Remittance Services whether as the individual in the capacity of the Sender submitting a Transaction order through the Instapay App or as a Beneficiary.
The Remittance Services are provided to you by Instapay in partnership with the Partner Network. These services allow Instapay Account holders to utilize the money remittance feature in the Instapay App to send money (i) within Malaysia and (ii) internationally to select locations around the world.
While the recipients of any submitted transactions do not need to have Instapay Accounts, please be aware that the Individual Remittance Services are currently limited to individuals and non-commercial person-to-person transactions. Sending money to business entities is not allowed for individuals. It is strongly recommended to use the Remittance Services only for transactions benefiting people you know personally, such as family and friends. You should not use these services to send money to strangers or unknown third parties.
By using the Remittance Services, you confirm and declare that:
You acknowledge that if any of these statements become untrue or if we discover any misrepresentation, we have the right to terminate any transactions you have completed (if already processed) without refunding the transaction amounts or transfer fees. We may also take necessary actions, including suspending, blocking, or terminating your account and that of the beneficiary (if applicable), without any liability to you.
Furthermore, you agree that in order to provide the Service, your (and your Beneficiary’s) personal information may be shared, transferred, retrieved, updated, and processed among Instapay and its parent company, subsidiaries, associates, related corporations, affiliates, licensees, agents, vendors, service providers (including Partner Networks), and any other parties involved in delivering the Service. This may include regulatory authorities (such as Bank Negara Malaysia) and card or payment network operators, as outlined in our Privacy Policy, to which you consent. You confirm that you have read, understood, and accepted all terms and conditions associated with this Agreement and the use of the Service, and that they are legally binding on you.
The provision and use of the Remittance Services are subject to specific conditions and restrictions. By using these services, you agree to the following:
Unless restricted by law, regulation, or regulatory authority, if a transaction is canceled and you submit a refund request to Instapay within 2 years from the transaction date, Instapay will issue a full refund without unnecessary delay, and in any case, within 7 business days from the date of your refund application. Instapay reserves the right, at its sole discretion, to refuse any transaction order or to limit the amount to be transferred, whether on a per transaction basis or in total, at any time and for any reason.
Current remittance limits and thresholds set by Instapay, as well as those for specific user categories (such as Malaysians, expats, foreign workers, and others, if applicable), will be displayed or communicated to you when you place an order on the Instapay App.
Please note that some Partner Networks may impose their own restrictions, resulting in higher minimums or lower maximums than Instapay’s limits. Instapay retains the right to enforce any transaction limits set by these partner Networks without any liability to you.
7.1 We would draw your attention to our Data Protection policy available from our Correspondents and prominently displayed in each of our Correspondents' place of business. In particular we would draw your attention to those provisions relating to the transfer of your personal data outside of Malaysia
8.1 If you need to make a complaint relating to the Service, please contact Instapay's Customer Services by telephone, post or email as set out in Clause 12.
8.2 If Instapay is unable to resolve your complaint you may also complain to Bank Negara Malaysia at 1-300-88-5465.
No person other than a party to the agreement will have the right to enforce any provision of the agreement.
In the event any provision (or part provision) of the agreement (whether in the Terms of the T&C) is held by any court or authority of competent jurisdiction to be invalid, illegal or unenforceable that provision or part-provision will, to the extent required, be deemed not to form part of the agreement, and the validity and enforceability of the other provisions of the agreement will not be affected.
Customer Due Diligence (CDD) is a requirement under the Anti-Money Laundering and Anti-Terrorism Financing Act 2001 (AMLATFA) and Money Services Business Act 2011 (MSBA). CDD shall be conducted on customers conducting any transaction. Please produce your identification document before making any transaction.”
